SCARE CANYON RANCH ASSOCIATION

GENERAL MEETING MINUTES

August 16, 2007

Harrisville Senior Citizen Cabin

Meeting began at 7:00 p.m.

Derek Hunwick,  SCRA President, conducted the meeting.

1.  Some Mallard Ducks have been shot in Twin Ponds area.  This is a federal offense.

2.  Three reports of shooting in Mountain Quakes.  There is no place in Mountain Quakes far enough from a cabin to shoot.

3.  Introduced new SCRA property owners:

            a.  Keni Craven, purchased Dale Perkins cabin.

            b.  Chris & Sherri Roby, purchased Steve Woody’s cabin.

            c.  Chris Draper, purchased Cotton Rosser’s cabin.

4.  Blair Lierd, representative of the Hideout, is a non-voting member of our board.

            a.  Jim Nelson asked how Derek can appoint someone on the board whether voting or non-voting.  Derek said the board discussed it and voted to have them be an interface with us.  Jim said he didn’t have a problem with them being part of our association, but not on the board unless voted in.  Derek said the contingency clause was exercised to bring a representative on as a non-voting member.

5.  Several asked why we allow Hideout folks to be part of our association.  Derek referred to his newsletter that listed several positive reasons.

6.  John Lewis explained that several questions have been asked.  He wanted to let everyone in the association know what is happening.

            a.  He bought the Lindquist and Coldwater properties.  They will be subdivided into clustered cabin sites.

            b.  Willing to share any water they develop.

            c.  Wants to build a park or common area for everyone to use.

7.  Kent Whiteman welcomed John Lewis.  He said we’ve heard horror stories about developers and asked how we can be assured we won’t be blindsighted.

            a.  John explained he’s been in the Ogden Valley about 12 years.  He feels the cluster development provides better planning.  He plans to have the same density as SCRA has today.  They haven’t gone to the county with a plan as yet.

            b.  John said they went to Derek right away to make sure they’re doing things correctly.

8.  Jim Spencer asked what the zoning was on the Lindquist Property.  FR40.

            a.  What about the Coldwater property – FR40

            b.  Does Cache County required certain things?  The County will assure he’s bonded before giving him final approval.

9.  John said Utah is a non-disclosure state. At this time, they really don’t know what they’ll sell the lots for and probably won’t for a year or more.  He doesn’t feel it’s mainly his development that is the cause of tax increases.  There are a lot of other big expensive cabins all around SCRA.

10.  John feels SCRA isn’t taking advantage of the Greenbelt tax status.  Jim Spencer said it’s been looked at, and there were some problems keeping our non-profit status.  Jim Nelson said Greenbelt is a fence-in not a fence-out.  John agreed.

11.  John feels he can help bring legal support to SCRA and provide ways to require people to pay their dues.

12.  Richard Roberts said this is a rustic area.  John said he doesn’t want things to be different than it is now.  He’s not planning to change the density.  Cluster doesn’t mean building next to each other.  He plans 2,430 acres with about 64 cabins on it.

13.  Jim Nelson asked what he means by two associations.  John said the Hideout will have their own Homeowners Association and will also require them to join SCRA.

14.  Jim Nelson asked if John got another right-of-way in SCRA.  John said we share the right-of-way.

15.  Mardell Amundsen asked about opening the roads to the public.  John doesn’t have any new information from Cache County on the issue.  They will certainly support SCRA in whatever we want.

16.  Cal Pack asked if the owners or the Hideout HOA will pay dues to SCRA.  He also asked if SCRA will be able to pay fees to the Hideout HOA and have the same privileges.  John said he isn’t sure.

17.  Mrs Ellis asked if John was trying to buy more land.  John said he would like to buy more from Coldwater, but he’s probably done purchasing.

18.  NEW MAIN GATE:

a.  John is planning to build a new front gate.

b.  Ray Gibbons said the front gate is too short for bringing heavy equipment through it.  John said they’d make sure it’s high enough – probably an additional two feet.

19.  Kathy Rochell read March general board meeting minutes, and they were approved as read.

20.  Derek went over the Financial Report.

            $4,035 in Grader Account

            $6,679 in the General Fund.  There will be approximately $3,000 more spent on roads.

21.  Upper Springs and Indian Springs are both operational.  Both have been checked and no contamination.

22.  Cache County isn’t going to grade Ant Flat until September.

23.  Fire Crews pulled out and probably won’t be back up until October or November.

24.  HUNTING ISSUES:

a.  Monte reminded everyone that come this hunting season, everything you can see from the road is huntable. Cannot go out behind Max Eddy’s Cabin.  Blair showed a map of the 2400 acres they purchased from Coldwater. (See attached)  They’ve agreed to let SCRA hunt about the same as last year.  Signs will be placed around the areas they don’t want SCRA hunting.

b.  Be sure you have window decals and hunting permits.  Deputies will be up there and have been instructed to check closer than last year.  If Deputies ask for hunting permits, please show them.  Jim Nelson asked how we are paying the Deputies.  Derek said we’ll provide them with a hunting permit like last year.

c.   Matt Burgess, Division of Wildlife Resources, will also be up in SCRA checking during the hunting season

d. No ATVs off road - Foot traffic only.

            e. Moose Permits – Please let Monte know.  You’ll need a special permit.   If you have a moose tag, call Blair, and they might work something out to allow hunting on some of their posted property.

f.  Kent Whiteman and Riley Skeen have posted their property.   They want to know who is hunting on their property.

25.  Mike Dean asked what is going on with the second gate.  Derek said the Association voted to keep it locked.  If we go to electronic lock, we won’t be utilizing the second gate because it would be cost prohibitive.

            a.  Dennis Bollom asked how we should secure the upper property.  Derek said same as now.  At the work party several checked the fence at the main gate and it’s as secure as we can make it.  It’s everyone’s responsibility to challenge anyone up there without a sticker.

            b.  Tom Whitaker said John talked about fencing his property.  He plans to do as much security as he can.

26.  ELECTRONIC KEY ISSUES:  We are working with John Lewis to redo keys and put in an electronic locking system

            a.  Jim Spencer said the electronic gate could provide information on who has been through the gate.  Derek agreed the electronic gate will provide an element of control and anyone causing problems will have their key privileges taken away.

            b.  Randy Rochell said if someone buys new ground, sometimes the previous owner has keys but won’t provide the new owners with them.  The electronic gate will help solve this problem.

            c.  Derek said they plan to allow no more than 6 keys per our bylaws.  Anyone who owns property is allowed to purchase one key.  Members will be allowed to purchase up to six keys.

            d.  Stacy Shelton asked how much the new electronic keys would be. The cost has not been determined as yet.

            e.  Cal Pack asked if we want five new keys, will we have to buy five new ones.  Derek said yes.

27.  Sherri Roby asked if there is a listing of everyone in SCRA.  Derek said no because it falls under the privacy act.

            a.  Stacy Shelton asked if we could have names and lot numbers published on the web.  Derek said it’s probably all right since its public information at Cache County.  Stacy made the motion to put names and lot numbers on our website. Jim Spencer seconded the motion.  There were no dissenting votes.

28.  Jim Spencer asked who has the best cell phone service up there?  Derek said that Bill Shurtleff is over the scout project to identify cell phone locations.

29.  Jim Spencer motioned we adjourn.  None opposed.
