BOARD MEETING MINUTES
September 17, 2008

Meeting began at 6:00
p.m.

Old Business:
Marilyn read the August
14, 2008 Board Meeting Minutes and they were approved with corrections.
New Business:
1. Hideout Briefing
John Lewis from the
Hideout presented an update on the Hideout and handed out DVDs with their
marketing and background that should answer any questions the Board and
Association would have. It is no longer a “cluster community” and will
entail 49 lots, with designated building envelopes and no lot will be
smaller than 40 acres. Will be a green build with use of solar and wind,
look like it is part of nature and build to a rustic 100‑year-old theme.

Hideout will have 6-7
miles of ATV trails. Ray asked if SCRA members will be allowed to ride
their trails, John Lewis responded no, they must protect their trails from
over-use and therefore, Hideout will be a closed environment.
Hideout is proposing a
common access park with bowery, fire pit, etc. across from their current
gate and it would be a shared amenity with SCRA. Bob Wallis commented a
common use area would be nice.
Reviewed Hideout maps
in conjunction with how it sits within SCRA, addressed the legal easement to
the properties of Trujillo and Jardine, Federal Property, etc.
2. Public Road
Issues/Concerns
Ray met with the Ruby
Pipeline/El Paso representative, and they (Ruby Pipeline rep) had heard
Cache County is holding off on the Public Road until the Ruby Pipeline is in
and they (Cache County) would then use the pipeline road/easement. Ray told
them no, Cache County is not utilizing the Ruby Pipeline easement/road and
Ruby Pipeline would put that in writing. Bob commented if the right of way
is given to Ruby Pipeline, it must use it where it is, can’t give it away
for other use.
John Lewis commented
his utility project manager specialist (and friend) looked into the pipeline
routes and is familiar with the Ruby Pipeline Project and Ruby Pipeline must
choose one of three established routes. He personally doesn’t think the
Ruby Pipeline route through SCRA will happen as it would be too expensive to
build the road to support the construction of the pipeline. Blair Leird
reviewed the proposed pipeline route with Bob on the SCRA/Hideout map.
Debbi Spilker had heard
Hideout is building another road/access into the Hideout from below…can John
describe the proposed road and where it would come in from? Bob Wallis
asked if there was another access off Ant Flat road the Hideout was
considering.
John Lewis said no,
there aren’t any other roads except what is on their original plans, the
road they may have been referring to is from the bottom of Scare Canyon,
through the Church property and isn’t more than a “foot-trail” into
Hideout from the bottom of the canyon and is too hairy to develop; he
wouldn’t even want to take a 4-wheeler on it.
Ray asked about the
Federal Property again, if it is accessible from the bottom, and John
confirmed on the map the Federal Property is bordered on three sides by the
Hideout, and has its own 28’ corner/border onto Rocky Ridge Road. Blair
said you could legally walk into the Federal Property, but you could not
drive in. Ray said that is another argument SCRA has against the Public
Road.
John Lewis said the
Hideout plans to make improvements to the SCRA road from the first gate
through to the Hideout Gate.
Hideout has begun
issuing their own stickers – they are black with the Hideout Logo. They had
heard about the confrontation at the first gate and hope their stickers
would preclude any problems. Hideout will also have their own security
during the hunts.
At this time, Mike Dean
updated Blair on the information Ryan Leishman had given him pertaining to
the confrontation, and also told Blair that any member within the
Association has the right to challenge anyone in a vehicle without a SCRA
sticker.
Mike also said we need
to have a security rep up patrolling, checking permits and can SCRA
utilize/share the Hideout security people. Ray said any monies could be
negotiated and SCRA could pay their fair portion.
Doug Stuart asked if
the Hideout security would have jurisdiction to prosecute, or only kick out
the offender.
Ray said we will have
someone at the gate during the hunts checking IDs, permits, etc., and
although they won’t have the authority to arrest, they can prevent
unauthorized people from coming in.
3. General Meeting
for November 2008
Marilyn addressed the
General Meeting scheduled for November 20, 2008. SCRA has outgrown the
Harrisville Log Cabin and it can no longer support our needs, and Becky
Burt, a SCRA family member who works for Marriott-Slaterville City Offices
had made the suggestion of using their town hall. Marilyn and Ray had
spoken with the scheduler at Marriott-Slaterville and in November, the town
hall is available only on Thursday, November 13. The Board discussed this
and agreed unanimously to move the date and location for the November
General Meeting. Marilyn will ensure the Association knows of the location
and date change with the meeting invitation.
At this time, Blair
Leird and John Lewis were excused.
4. Keys
Ray said we need to
decide upon multiple owner/multiple dues paid owned lots.
For single-owned lots,
the Board discussed and unanimously agreed to continue to adhere to the
decision of 4 keys per lot. Debbi Spilker asked for the background on this
to better understand the rulings, and Ray updated her on the By Laws in
regard to amount, cost of keys, multiple-owned lots, etc., and said the
Board will address them separately.
Debbi asked what Little
Paradise is and how is it a multiple-owned, multiple-dues paid lot. Ray
explained the background of Little Paradise.
After much discussion,
review, Bob Wallis made the motion for “multiple-owner, multiple dues paid
lots to give/assign 2 keys per owner with dues paid.”
Chris Roby seconded the
motion.
Ray conducted the
voting and all were in favor.
The Board discussed key
exchanges in different locations (Centerville, Ogden, North Ogden, Brigham
City, etc), mailing a key (in a box) registered mail/return receipt, making
arrangements on a case-by-case request and meeting the owner to exchange
keys.
Mary Lou said two
owners have requested a refund of their dues over the key issue, and she
will work with Doug on which owners got refunds, and which had been given
keys.
Additional keys for
non-SCRA land owners:
Ray received a call
from one of Coldwater’s herders, and Doug/Bob said they will honor what had
been done in the past - exchange one key for one key. Ray said the herders
have never abused their key use, nor lost any keys. The herders only come
on SCRA to retrieve stock that have come through the fence line.
Bob will exchange keys
with Cache County Sheriff’s Office , Fire Crew. Doug will exchange keys
with DWR; Ray will take care of the herders’ key exchange direct and let
Mike Olson know of the exchange.
Additional keys for
outside sources will be handled and discussed on a case-by-case need.
Hunting Permits:
Ray has two permits to
turn in. Mike asked Ray what his opinion/interpretation of signs stating No
Trespassing is. Ray said if a sign says No Trespassing, that is exactly
what it means, doesn’t matter if it is on your gate, or fence line. If it
says No Trespassing, then it is posted and you can’t hunt it nor hunt anyone
else’s property.
Mike asked the Board if
we are going to use Cache County deputies? Ray and the Board agreed we
should have some type of security on SCRA and make their presence known. It
could stop many problems from happening. Ray said Deputies wouldn’t have
jurisdiction because SCRA isn’t legally posted No Trespassing (every corner,
border, trail, gate, etc.).
Ray said it will be the
Board’s decision if we use officers - all officers are licensed within the
State of Utah and can work outside their area of assignment.
Chris made the motion
to hire off-duty officers. Adam seconded the motion, with the addition of
having the officers in uniform so they can be readily identified.
Debbi seconded the
motion to hire off-duty officers, and for them to be in uniform.
No one opposed, all
were in favor.
Bob will get a list of
officers from the Cache County Sheriff’s office. Mike asked how much will
be approved to pay them, and Ray said it is open for negotiation and we’ll
need to work out the details with Cache County then have the Board vote and
approve the monies.
Mike talked about the
By Laws and multiple-owned/multiple-dues paid lots. Everyone addressed this
in relationship to the keys, and the issues associated with them.
Chris and Mike will
work together on a proposal and come prepared to discuss at the next
meeting.
Ray addressed how we
will conduct the November General Meeting - for example, coming forward to
the microphone, stating your full name, your issue/concern, and a 3-minute
time limit per person.
Also, the Board
proposed they should send their request to the Board/or the Web Page and
they will acknowledge those members first, and time permitting others could
come forward.
Ray Gibbons made the
motion to adjourn, Chris Roby seconded
