OLD BUSINESS:

 

Marilyn Dean read the March 25, 2010 General Meeting Minutes and they were approved as read

 

NEW BUSINESS:

 

Ray thanked everyone for their help and contributions for the picnic and clean up day – it was a great success.

 

- Ruby Pipeline has been moving equipment in and although they are behind schedule, they’re going to work until they’re pushed out by the snow.  This will interfere with hunting as they’ll be working through every hunt.  They have a 150 foot right of way/easement we will need to respect.  Let’s keep this hunt accident free and stay well back from their machinery and right of way.

 

- There will be no hunting on the Hideout and Coldwater without written permission.  Both continue to be posted No Trespassing.

 

- If you post your property No Hunting/No Trespassing, send a letter to SCRA Board Member Mike Dean plus post visible signs so all know it is a No Hunting area.  Mike’s phone number is (801) 391-2627, his address is:

- Ray cannot stress traffic problems enough – there is over-sized equipment on our roads and there is no room for passing…be extra careful on ATVs.  We’ve had to widen our gate to allow passage of their over-sized trucks.

 

Following is a compilation of issues and concerns voiced by Association Members and answered by Ray Gibbons:

 

- The Ruby Pipeline easement through the main gate had to be widened, are we widening the second gate too?  Ray said we may need to take the arch down at the second gate, and if we need to widen that gate, Ruby Pipeline will pay to replace it.  Also, Ruby Pipeline must comply with FERC and when all work is completed, roads will be returned to original or better than original condition.  Work will be guaranteed to our Association’s satisfaction before FERC passes off on the project.

 

- What will happen to Scare Canyon’s carved gate that was removed?  Nothing, it is being stored on my property until the Ruby Pipeline is finished then it will be restored or incorporated into a new gate.  It is part of our history and we will continue to use it.

 

- How many miles of road will SCRA be compensated for?  Ray – 12 miles of road from the front gate to Spring Drive into the canyon on the west.

 

- Will Ruby Pipeline increase the number of work days per week with their late start?  Ray: nothing as yet – Still Monday through Friday and possibly Saturdays.

 

- Hideout is starting to clear trees/brush, are they building more cabins?  The Hideout is currently building one cabin, will check with Cache County to see how many lots have been sold and how many building permits have been applied for.

 

- How many acres is Hideout selling as a cabin lot – Ray:  Each lot is 40 acres.

 

- There was a confrontation at our main gate over the notice John Lewis posted on cutting trees. Ray – John realized his mistake in inviting the public into a private area.  John escorted them as guests; he wasn’t going to let them in without an escort and replied it won’t happen again.

 

-  Where are we with the Hideout regarding number of keys, negotiations for access.  Ray:  John Lewis requested 100-200 keys and said he would distribute as clients bought.  A vote by the Association would need to be made to give out this many keys – with 40 lots, that would be up to 5 keys per owner which is more than our By Laws state.  Ray said we are working with the Hideout on an Access Agreement that each new buyer would sign and keys would be distributed by us (SCRA), we are also negotiating cabin construction fees for the increased heavy equipment on the roads, and trespassing laws would have to be abided by, etc.

 

-  Will John Lewis be agreeable to work with us on more than 1 key.  Ray – they currently are working with us on key issues.

 

-  Does the Hideout have an interest in Timesharing their cabins/lots.  Ray, no, he has read the Hideout By Laws and they do not allow Timeshares.

 

-  Hideout has put a stump at the airport road, looks like a gate could close off Rocky Ridge.  Ray – we haven’t received notice that Hideout is going to block the road.

 

- Rumor of John Lewis hiring George Daines to represent the Hideout over road issues/access.  Ray, we are currently working with John Lewis and he has not said that he is contacting a lawyer.  Scare Canyon is not denying the Hideout ingress/egress, but cannot give them more keys than our own members are entitled to. Discussion followed regarding roads, deeded right of ways, By Laws, working towards an amicable outcome, etc. Comments we need to move forward.

 

- Ray proposed talking to John Lewis and inviting him to a Special General Meeting regarding the Hideout and Scare CanyonA Member proposed the Association submit questions in advance, abide by the agenda and keep the meeting productive.  Ray proposed we could invite an impartial party to mediate the meeting.

 

- Could we rewrite or change the SCRA By Laws to incorporate SCRA and the Hideout into one Association.

 

Jim Spencer made a motion to the Board and Association to not change the By Laws to accommodate the Hideout or anyone.  Ron Hill seconded, Ray asked if there were other comments to the motion, as there were none, Ray accepted the motion and the secondSCRA By Laws will not be changed without future discussion and a vote by the Association.

 

- Discussion followed on our attorney, Mark Pollott, and what he is doing for the Association.  Chris Roby responded he is currently on retainer.  Member asked if John Lewis approached the Association regarding road issues could it be kept out of court.  Ray responded the Special General Meeting would be a good time to address all Hideout issues with John Lewis.

 

- Discussion on the Lower Spring and improvements/repairs to be made.  Ray responded the Board has scheduled the work to be done this month, and will finalize all repairs by late fall.

 

-  Discussion of ownership of Griffin Spring and who can file on it.  Ray said currently the request has not been decided in favor of Derek Hunwick and if possible, SCRA will file on it.

 

Randy Rochell made the motion the meeting adjourn, Nona Ellis seconded.

 

Ray invited everyone to stay and socialize and enjoy the refreshments.
